(a) Basic requirements for employers:
1) Entities of the employers shall be founded in accordance with laws. They shall have no record of severe violations of laws or dishonesty. Posts for foreigners, without violating regulations specified by the state, shall have special demands while qualified people cannot be found within China. Salaries or wages for foreign employees shall not be lower than the local minimum level.
2) If prior approvals from relevant competent departments in industries are required according to laws and regulations, preliminary reviews shall be conducted.
(b) Basic requirements for individual applicants:
1) The foreign national concerned shall be 18 years old or above, in good health, and without criminal records. He/she shall be employed by a certain employer and have proficiency in professional skills or appropriate knowledge necessary for his/her job responsibilities.
2) The foreign national, who is an urgently needed professional, shall engage in a job that meets the needs of the economic and social development of China.
3) If there are any other laws or regulations for the employment of foreign nationals in China, the corresponding laws and regulations shall prevail.
